Public Accountant Status: Expiry, Suspension and Audit-Partner Titles

The 2017 bulletin explains three situations that may breach section 56(1), the historical renewal/reinstatement timetable, suspension employment consent and safeguards for non-registered partners’ titles.

Source checked · 11 October 2026 Historical document

Registration and limited-purpose accountants

Only registered persons may provide public-accountancy services: audit/reporting and acts the law reserves to public accountants. Judicial-manager/trustee-only registered accountants mentioned in the bulletin cannot audit without prior PAOC approval. A title or qualification alone does not establish permission to deliver every reserved service.

Section 56(1) and historical penalties

An unregistered person must not practise, hold out or use a title/description implying registered or authorised public-accountant status. The source gives first conviction up to S$5,000 and/or 12 months imprisonment, later convictions up to S$10,000 and/or two years. These are statutory maximums quoted in the 28 March 2017 bulletin, not automatic penalties for every case.

Expiry and removal from the register

Failure to renew within one month of certificate expiry leads to removal, described as after 31 January and cessation from 1 February of the following year. The footnote excepts pending complaints or disciplinary proceedings. Notice of removal permits a reinstatement application within 21 days, but CPE and applicable PAOC orders still must be satisfied. Continuing reserved services after removal risks section 56(1) proceedings.

Suspension and employment consent

A suspended accountant is deemed unregistered during suspension. Section 59(1)(b) requires PAOC consent before a practice or accounting entity knowingly employs or remunerates someone suspended or cancelled under Part V or VI for public-accountancy business. The rule concerns employers and recipients, not only signing the report.

Avoid holding out during suspension

Take positive steps to avoid misleading clients, inform them of the changed engagement partner, and avoid signing engagement letters or audit reports personally or for an entity. Employment consent should not be treated as reinstating registration or authorising the suspended person to sign as statutory auditor.

Partners or directors not yet registered

The Act may allow non-public-accountant partners/directors subject to composition conditions. The historical footnote gives at least two-thirds professionals, or at least one where only one or two directors/partners. An audit-related title must carry context on name cards, email signatures, proposals and client communications making non-registration clear. Correct misunderstandings reasonably known.

The three published risk situations

The bulletin focuses on reports signed after removal, audits during suspension and audit-partner/director titles before registration. It explains safeguarding public confidence and ACRA’s enforcement intention. This historical guidance does not reproduce every registration rule or verify any person’s current status.
