Two commencement dates in S 552/2026
The twenty-page gazetted amendment was made and published on 11 August 2026 under section 105 P of the Income Tax Act. Regulation 4, amending principal regulation 7, takes effect that day; all other amendments take effect on 1 January 2027. The instrument updates references to the OECD CRS as amended on 8 June 2023. Publication in 2026 does not mean every provision already applies in 2026.
Own-account dealing exclusion effective in August 2026
The new regulation 7(2 A) excludes from paragraph (1)(c) a person exempt from a capital-markets-services licence under Securities and Futures Act section 99(1)(h), read with Second Schedule paragraphs 2(1)(a) or (e) of the licensing/conduct regulations, who deals in capital markets products for that person’s own account. Regulation 7(3)(a) is deleted. This is a defined statutory exclusion, not a general exemption for every investment business.
Qualified non-profit financial institutions require confirmation
New regulation 10 defines a Qualified Non-Profit Entity as a financial institution established in Singapore as a registered charity under Charities Act section 7, or an exempt charity under section 2(1), that receives the Comptroller’s written confirmation of all CRS VIII B(10) conditions. The schedule adds this class to non-reporting financial institutions. Charity status alone does not meet the new definition.
All five non-profit conditions
The entity must have exclusively specified religious, charitable, scientific, artistic, cultural, athletic or educational purposes, or be a listed professional/business/civic/social-welfare organisation; be income-tax exempt; have no members/shareholders with proprietary or beneficial interests in income/assets; prohibit private distributions except charitable activities, reasonable service compensation or fair-market-value purchases; and require liquidation assets to go to government or another qualifying entity, or escheat to government. Singapore replaces the jurisdiction placeholders.
Registration and trustee responsibility
On a compliant reporting-FI application the Comptroller must register unless there is a reasonable excuse not to do so. For a reporting FI that is a trust, its trustee must satisfy regulation 13 registration requirements and the regulation 14(1), (5) and (7) requirements; regulation 14(9) is extended to trustees. Reporting under regulation 16(1)/(3), read with its format/method requirements, likewise rests with the trustee.
Separate old and newly brought-in pre-existing accounts
Regulation 15 retains the 31 December 2016 reference for accounts within paragraphs 13(a)/(b), and uses 31 December 2026 for financial accounts within 13(c)/(d) brought in solely by the revised CRS. For the newly included pre-existing individual accounts, high-value review finishes by 31 December 2027 and lower-value review by 31 December 2028. A financial account solely brought in by the amendments and opened from 1 January 2027 is a new account unless the specific pre-existing-account conditions apply.
The entity-review clause contains a date requiring careful reading
New regulation 15(7 A) sets 31 December 2028 for review of newly included pre-existing entity accounts with aggregate balance/value exceeding U S$250,000. Its printed wording says the balance is tested as of 31 December 2016, whereas surrounding new-account references use 2026. This article preserves that printed distinction rather than silently rewriting the gazetted text. Check the official instrument and subsequent clarification before deciding a real review population.
Five requirements for later accounts to be pre-existing
Paragraph 13(d) covers another account maintained from 1 January 2027 only if: the holder had a newly included account with the FI or related local entity at 31 December 2026; the relevant accounts across those entities are aggregated as one for prescribed thresholds; no known reason makes certifications/evidence unreliable; any legally required AML/KYC procedures are performed; and opening requires no new/additional/amended holder information except to facilitate regulations 14 or 16. Related threshold provisions extend to these accounts.
U S$1 million individual threshold and transitional role fields
High-value means aggregate balance/value exceeding U S$1 million at the relevant 2016 or 2026 year-end, or a subsequent year-end; lower-value uses a balance not exceeding that amount at its respective baseline. For reportable accounts maintained at 31 December 2026, controlling-person and legal-arrangement equity-holder roles are required for calendar 2027/2028 only if available in electronically searchable data. This is a limited two-year role-information transition, not a waiver of all reporting.
Returns, CARF overlap and trustee-documented trust nil reporting
A return not meeting regulation 16(5)/(6) is treated as not made. CRS reporting definitions are locally modified; the CARF reference is S 551/2026. New 16 A requires the trustee of a non-reporting trust within CRS VIII B(1)(e), maintaining no reportable account during a year, to file that fact by 31 May of the following year or a permitted later date, in IRAS’s prescribed format. Failure without reasonable excuse is an offence under 105 M; regulation 17’s coverage extends to 16 A.
New reportable data and duplicate-proceeds relief
Report holder identity/tax residence/TIN and individual birth details together with valid-self-certification status; for reportable controlling persons include their roles and certification status. Add joint-account status and holder count, account type and pre-existing/new status, and roles of equity holders in investment entities that are legal arrangements. Existing-account TIN/birth-date collection extends to required AML/KYC updates. Gross financial-asset disposal proceeds already reported under CARF need not be repeated under CRS, unless the FI elects otherwise for a clearly identified account group.
Due diligence when AML/KYC or certification is insufficient
New-entity-account controlling-person AML/KYC must align with the 2012 FATF Recommendations; institutions not legally bound to such procedures must apply substantially similar procedures. Only in exceptional circumstances where new-account self-certification cannot be obtained in time for that period’s obligations, apply pre-existing-account due diligence until certification is obtained and validated. It is not a routine permission to open all accounts without certification.
Digital assets expand institution and financial-asset definitions
Depository Institution now also includes an entity holding specified electronic money or central-bank digital currency for customers. Investment-entity activity and financial-asset definitions extend to relevant crypto-assets. However, merely providing services effectuating exchange transactions is excluded from the specified investing/administering/managing-on-behalf activity. A reporting crypto-asset service provider conducts customer exchange transactions as business, including counterparty, intermediary or trading-platform services.
All five specified electronic-money features and the sixty-day rule
The product digitally represents a single fiat currency; is issued on receipt of funds for payments; is a claim on the issuer in that currency; is accepted by persons other than the issuer; and is regulatorily redeemable on demand at par in the same currency. A product created solely to transfer funds on customer instructions is excluded. Ordinary holding longer than sixty days after transfer instructions, or after receipt when no instructions arrive, defeats the solely-for-transfer condition.
Currency, crypto-asset and exchange definitions
Central-bank digital currency is digital fiat issued by a central bank. Fiat includes official physical/digital money, bank reserves, CBDC, commercial-bank money and electronic-money products. Crypto-assets rely on cryptographically secured distributed ledgers or similar technology. Relevant crypto-assets exclude CBDC, specified electronic money and assets adequately determined unusable for payment or investment. Exchange transactions cover crypto-to-fiat and crypto-to-crypto exchanges.
Government bodies and the expanded depository account
Governmental entities, international organisations and central banks are not automatically non-reporting for commercial financial obligations of the specified kind, or for maintaining CBDC for holders outside the listed institutional/government categories. Depository Account now includes a notional account aggregating a customer’s specified electronic-money products and an account holding CBDC, alongside traditional deposits and the insurance interest-bearing guaranteed-investment category.
Capital-formation escrow: all five exclusion conditions
The escrow exclusion can cover company foundation/capital-increase accounts only if exclusively used for legally prescribed capital; blocked until independent formation/increase confirmation; closed or converted to the company’s account afterward; failed-formation repayments, net of provider/similar fees, go only to contributors; and established no more than twelve months earlier. A general business cash account does not satisfy this merely because capital was paid into it.
Electronic-money low-balance exclusion and further definition changes
An account representing all a customer’s specified electronic money is excluded if its rolling ninety-day average of end-of-day aggregate balance/value never exceeds U S$10,000 on any day of the reporting period. This is not simply a year-end balance test. The publicly traded-entity references change from corporation to Entity. Government Verification Service means an electronic process supplied by a reportable jurisdiction to establish holder/controller identity and tax residence.
Practical implementation without merging different dates
Map newly covered products and institutions, distinguish 2016 versus 2026 account populations, preserve aggregation and reliable evidence, identify trustee duties and required data fields, and schedule 2027/2028 reviews and role transitions. These steps follow the amendment’s structure; the article does not substitute a current consolidated regulation for the published amending instrument.
