2023 model and signature declaration
These seven pages are OECD 2023 pages 69–75, not a completed Singapore-specific signature instrument. The declaration leaves authority name/title, jurisdiction, signature place and date for completion; signature and an activated bilateral exchange are different. English and French versions are equally authentic.
Section 1: five definitions
A jurisdiction must have the Convention in force/effect through signature/ratification under Article 28 or territorial extension under 29 AND sign this agreement. Competent authorities are Convention Annex B persons/authorities; CARF includes OECD/G20 framework and commentaries. Secretariat is the OECD coordinating-body support under Article 24(3). Agreement in effect requires BOTH authorities’ section 7 notifications and mutual listing, with OECD publication. Undefined terms follow compatible local law, tax-law meaning prevailing.
Section 2: reciprocal and non-reciprocal flows
Under Convention Articles 6/22 exchange annually. A jurisdiction notifying non-reciprocal status SENDS but does not receive; reciprocal jurisdictions receive from it but do not send to it. Do not assume every signatory exchanges both ways with every other signatory.
Identity and provider fields
For reportable users and relevant controlling persons, include name/address/residence jurisdictions/TINs/date/place of birth. For entities include corresponding entity details and each controlling person’s role. Report provider name/address/identifying number. These are exchanged after CARF due diligence, rather than a list of all blockchain users.
All nine crypto-asset categories
For EACH relevant asset type: full asset name; aggregate fiat acquisition gross paid/units/transaction count; fiat disposal gross received/units/count; crypto-for-crypto acquisition fair value/units/count; crypto-for-crypto disposal fair value/units/count; reportable retail payments fair value/units/count; other inbound transfers fair value/units/count split by type where known; other outbound transfers similarly; and outward transfers to wallet addresses not known to belong to a VASP/financial institution, with fair value and units. The last category does not add a transaction-count requirement in this text.
Section 3: beginning year, schema and channel
Start with the year notified under 7(1)(a), exchange within nine months of calendar-year end, and only when BOTH have corresponding CARF laws for that year. Use common schema and OECD Common Transmission System/encryption/file standards, or notified alternative. The model itself does not set one universal first year or domestic provider filing date.
Sections 4–5: error handling and safeguards
Notify suspected incorrect/incomplete data or provider non-compliance; recipient authority acts under local law. Convention confidentiality/use and notified supplying-country safeguards apply. Immediately inform Secretariat of breach/failure and sanctions/remedies; it notifies authorities with activated agreements with the affected authority.
Section 6: consultations and amendments
Consult with one or more authorities; the initiator tells Secretariat the measures, which informs all authorities including non-participants. Amendment needs consensus written agreement of ALL authorities; default effective date is first month-day after one month from LAST signature.
Section 7: all seven notifications
At signature/as soon after, notify: laws/effective dates or provisional period; non-reciprocal status; any consent request for use concerning Article 30(1)(a) reserved taxes with specified taxes and Convention-compliant use; alternative encrypted transmission; personal-data safeguards; adequate confidentiality measures; and intended partner list after legislative entry procedures. Notify changes promptly.
Activation and publication
Two-party effect begins when the SECOND authority gives required notifications including listing the other. OECD lists signatories and activated pairs. Notices on laws/dates, non-reciprocity and safeguards are public; consent/tax-use, alternatives, confidentiality confirmation and partner lists are available to other signatories on written request. Signature alone is insufficient.
Suspension, termination and section 8
Significant non-compliance written notice to another authority suspends immediately, including data/safeguard failure. Termination of participation or a particular pair is written to Secretariat, default first month-day after twelve months unless otherwise specified; received data stays protected. Section 8 Secretariat circulates notifications unless otherwise provided and informs signatories when another authority signs.
