Corporate Tax Objections and Appeals: Grounds, Evidence and Deadlines

The corporate objection guide explains precise grounds, filing/review/appeal deadlines, finality and all eleven supporting-evidence scenarios.

Source checked · 11 October 2026 · Document date: 30 Jan 2026

Scope and the two-month objection window

The fourth edition dated 30 January 2026 describes a process effective from 1 January 2014. It covers assessments except those based on the taxpayer’s submitted ECI. Taxpayers include companies, registered business trusts, REITs and Singapore permanent establishments/foreign branches; from 22 March 2023 also sub-trusts, ETFs and private trusts excluding will-created trusts and intestate estates. File a written Notice of Objection within two months of NOA service. The NOA’s printed date is treated as service, even if received earlier; NOAs are generally post-dated seven days. A 6 June 2022 NOA therefore allows objection through 6 August 2022.

New amendments do not reopen old finalised items

An amended assessment may be challenged only for its amendment or related matters. The example’s 31 March 2021 exchange-loss disallowance received no objection and is final; a 30 September 2022 retrenchment-cost disallowance permits objection by 30 November 2022 only on the new adjustment. A later assessment does not revive the old exchange-loss issue. Acceptance in an earlier YA does not prevent challenging the same tax treatment in a later YA, because acceptance is per assessment year.

Precise grounds, valid examples and special cases

State YA, each disputed item, income/deduction amount and substantive reasons for deduction/relief or non-taxability. Prefer account/return descriptions. Revised tax adjustments/computation and supporting evidence are encouraged. Merely saying excessive, identifying a 2,000 legal fee without reasons, or calling property gain capital without facts is insufficient. Explaining that the legal fee drafted a sales contract producing trading income, or that a 2,000 exchange loss settled trade creditors and is revenue-nature, provides precise grounds. Estimated assessments due to missing ECI may use excessive only with revised ECI; missing-return estimates require the return and audited/certified accounts. For an identified industry-wide issue under CIT/Ministry review, referring specifically to that issue can suffice.

Filing methods, acknowledgement and extensions

Revise/Object to Assessment in myTax Portal is encouraged and gives instant acknowledgement. An Objection Form through myTax Mail or post gives acknowledgement within 14 days of receipt. A letter/email may be accepted with precise grounds, but a letter receives no receipt/validity acknowledgement. Acknowledgement validity rests on the declarant’s checklist/digital declaration. Request more time in writing within the original two months; approval is case by case. An invalid objection can be refiled before deadline. After expiry the assessment is normally final, although absence, sickness or other reasonable cause preventing timely filing may justify an extension at CIT discretion.

Review milestones and refusal to amend

Respond to IRAS queries normally within two months of its letter. CIT aims to decide within six months after the last correspondence containing complete information and schedules, not six months from the first objection; complex cases get an estimated completion date. Information still missing two years after receipt of objection may lead to Notice of Refusal to Amend after a final reminder. If accepted, CIT amends and finalises assessment. If not accepted, reply in writing within three months whether accepting the decision. No reply closes the objection and may produce refusal; disagreement or qualified agreement reserving a right to reopen also may produce refusal. Acceptance can be without prejudice to future YAs.

Appeal and finalisation

After refusal, accept or file Notice of Appeal to the Income Tax Board of Review within 30 days of refusal notice under section 79(1). The Board’s decision is final without a legal question. Appeal to High Court General Division requires law or mixed law/fact and disputed tax exceeding 200 under section 81(2). Further appeal normally goes to the Appellate Division, with Court of Appeal possible under governing conditions. Section 84 finality arises on agreement, no timely valid objection, no timely Board appeal or appeal determination after further rights are exhausted. Filing an objection and commencing court appeal are separate steps and deadlines.

Evidence for property gains, rent, professional fees and R&D

Annex covers eleven evidence scenarios. For property/share disposal supply identity/address, purchase/sale dates/prices, financing, acquisition/disposal reasons and studies/resolutions, buyer relationship and arm’s-length valuation where relevant, property use/vacancy periods, gain/loss computation and tax-character reasons. Rental classification needs units/addresses, services and employee/agent responsibilities. Legal/professional expenses need breakdown, services, circumstances and revenue-income purpose. R&D needs project benefits/end product/use, start/expected finish, whether performed internally or provider name/address, and cost breakdown supporting sections 14 C/14 D/37 F.

Evidence for interest, head-office allocation and allowances

For TAM dispute identify assets not funded by interest loans, financing method, bank/loan evidence and proposed schedule/computation. If interest adjustment is said not applicable, explain loan purpose, use of proceeds and link to income assets with board minutes/agreement. Head-office allocations need allocation basis, exclusion of domestic/head-office direct expenses, Singapore-branch expense analysis and disallowable items, service description/location and withholding compliance where performed in Singapore. Capital allowances require asset description/cost, purchase date, business use and claim basis. Renovation/refurbishment section 14 N needs qualifying-item confirmation/details and no section 14 N(9) prohibition.

Evidence for foreign services, guarantees and facility fees

For foreign-service double-tax relief provide payer name/address, service description/location/duration, expenses and accounting treatment, overseas PE existence/basis/taxation, gross fees/withholding rate/tax in foreign currency plus SGD, tax receipt date and treaty article. Fixed-asset construction standby-credit/bank guarantees require circumstances, fee calculation/agreement, loan connection/date and revenue-deduction basis. Facility fees require circumstances, interest substitution/reduction explanation, bank-by-bank loan amounts/use, balance-sheet presentation, prescribed-regulation schedule category and each loan agreement. This evidence list helps substantiate a contention; it does not automatically establish deductibility.

Edition changes and enquiries

The 2019 update added scenarios;2023 expanded taxpayer trusts and aligned litigation/statutory references, examples and current administrative procedures, removing older sample forms. January 2026 amended the general disclaimer. The source contact is 1800 356 8622. Keep the original guide available for its flowchart and itemised evidence checklist.
