What an advance ruling decides

The thirteenth edition, published30 January2026, explains written GST-law interpretations for a specific person and business arrangement under section90A and the Fifth Schedule. It binds the Comptroller of GST (CGST) for the ruling issued. An arrangement includes a contract, agreement, plan or understanding, enforceable or otherwise, and all implementation steps. Rulings address genuine interpretative uncertainty, not matters already clearly answered by law or ordinary administrative enquiries.

Examples inside and outside the system

Suitable issues include whether a defined business transfer is a going concern, where services under a particular overseas-company/Singapore-customer contract are supplied, and whether financial exemptions incidental to a defined taxable business fall outside published partial-exemption examples. Export/import documentation, refunds, payment/return/penalty enquiries and policy remission generally fall outside. Examples include invoices addressed to a transferor, using another registrant’s return, tripartite non-residential property input tax and dispensing with invoice particulars. The statutory Fifth Schedule and F19 also identify discretionary-decline and mandatory-no-ruling cases.

Past returns, imminent deadlines and hypothetical arrangements

The CGST cannot rule on a transaction already the subject of a filed return or a return due in less than one month. Expenses from a past accounting period cannot be accepted merely because input tax was omitted from its filed return. Submit at least one month before the relevant filing deadline, subject to an accepted express request. Hypothetical arrangements, arrangements not seriously contemplated and arrangements dependent on an unconfirmed event are also excluded. A completed transaction can still be considered if its application meets the specified filing-window requirements.

Applicant and arrangement-specific binding effect

A ruling covers only its named applicant and particular arrangement. Similar transactions or a related company’s ruling cannot simply be reused. For a GST group it generally covers only named persons. A later member registered under the same group number and entering the same arrangement may use it only with prior CGST approval, without additional ruling fees. Applying does not suspend returns, payments or other GST obligations, nor the CGST’s assessment powers.

Disagreement must be disclosed and may lead to assessment

An issued ruling is final. If you do not follow it, disclose in writing its date/reference, affected return periods, reasons and quantified differences between reported figures and figures under the ruling. The CGST may disagree with the return and raise an assessment. Objections to that assessment follow section51; this is distinct from treating the ruling itself as an appealable informal draft.

Three-year validity, cessation and withdrawal

Default validity is three years from issue unless the CGST decides otherwise. Request a different period and reasons with the application. A condition may require implementation by a deadline or automatic lapse. A relevant repeal/amendment changes applicability from its effective date, with written notice. Materially different implementation, omission/misrepresentation, an incorrect material assumption or an unsatisfied condition can end applicability early. The CGST can withdraw a ruling with reasons/effective date, for example after court or Board interpretation changes; arrangements entered before withdrawal remain covered by the withdrawal rule stated in the guide.

Consent and anonymised publication

For applications from1 May2019, a ruling summary may be published with consent given in form sectionE. TOGC rulings are not published, so they need no publication consent. A summary removes identities of applicant/arrangement/other parties, transaction dates and values. Published summaries are general reference only, not binding for another taxpayer, and IRAS does not update them for later legal or interpretative changes.

Publication review deadlines and removal

The first draft is sent within eight weeks of the ruling letter. Reply with reasoned edits or confirmation within six weeks; if a second draft is needed, the CGST sends it within six weeks of the first reply and gives six weeks for the second reply. No edits can move directly to publication. Publication is no earlier than six months after issue for applications before1 June2023 and nine months for applications from that date. No timely reply may allow publication after the applicable interval. Request a review extension at least one week before the deadline; it is considered case by case. Summaries published at least five years are removed by31 December each year. Preparing the summary has no fee.

Who applies and the two filing lead times

A person may apply themselves, for persons not yet legally created or jointly with others; any GST-group member may apply. Normally the supplier seeks a supply-liability ruling, possibly jointly with its customer. Use online GST F19 and complete information at least one month before the return deadline, or before transaction date if a pre-transaction ruling is wanted. An express request needs at least15 working days before the relevant deadline or transaction date, even though the accepted processing service may be10 working days. Do not confuse the application lead time with processing time.

The complete application information

Provide the arrangement/period, business reasons, relevant documents with passages identified and questions. Set out relevant GST sections, supporting case law/legal interpretation and contrary authoritative arguments. Report prior same/similar requests, outcomes and references, including rulings or written advice in the preceding two years. Include a different requested validity/reasons if applicable and a proposed ruling with recommended treatment/reasons. The CGST may waive the legal-analysis/prior-request/validity/draft items, but not automatically the core facts and issues. An agent requires a signed sectionE declaration. Pay the application fee with filing.

Additional statutory provisions and supporting files

The CGST may identify a relevant GST provision not mentioned in the application and notify you before ruling. You may proceed or withdraw, but accrued fees remain payable; proceeding or not withdrawing in the stated time allows the ruling to include that provision. If FormSG’s10MB file limit causes difficulty, email documents to GST@iras.gov.sg with the FormSG responseID. The guide asks applicants not to send hard copies, to avoid delay.

Ordinary fees and hourly rounding

The application fee is S$660 inclusive of GST and is non-refundable even if rejected or withdrawn. It covers the first four hours. Further time is charged at S$165 inclusive per hour beyond those four; the footnote specifies rounding to the nearest hour, less than half an hour down and half an hour or more up. The body’s “each or part hour” description should be read with that explicit rounding footnote. Reasonable costs/disbursements and external-professional fees are additional. The CGST informs you before engaging an external adviser so you can decide whether to proceed.

Express multipliers and estimated fees

An accepted10-working-day express ruling costs three times application plus further time-based fees;15-working-day express costs twice that aggregate. Thus the application component is S$1,980 or S$1,320 respectively before any further-time fee and reimbursements. These multipliers expressly apply to that aggregate, not automatically to all external disbursements. On accepting the application, CGST gives completion and fee estimates; written acceptance is required or it is treated as withdrawn. Pay estimated further-time and express additional fees when accepting. Withdrawal later still incurs time charges up to receipt of the withdrawal letter.

Final settlement and refunds

When ruling is issued or request withdrawn, any actual-fee shortfall is invoiced and payable within30 days of invoice. Overpaid estimates are refunded within15 working days after IRAS advises actual fees, provided payee name, account number, bank/branch code and SWIFT code are supplied. Clarifications about the existing ruling’s contents, such as required delivery evidence, have no added fee. A new delivery structure or question beyond the original scope may need a fresh application.

Payment currency and bank reference

The published instructions specify Internet Banking Fund Transfer to Inland Revenue Authority of Singapore, DBS current SGD account0010516000, bank/branch7171/001 and SWIFT DBSSSGSG. An applicant outside Singapore or with only an overseas account may use telegraphic transfer. Remit Singapore dollars and bear all foreign/intermediary bank fees so IRAS receives the full amount. Put UEN and/or applicant name in the beneficiary/payment reference for matching to the form; separate payment notification is not required. These are the bank instructions printed in the2026 source.

Processing starts only with complete information

Ordinary processing is within one month after complete information, including written acceptance and additional-fee payment. Complex cases may take longer, with the required time notified when accepted. Accepted express priority is10 or15 working days from the same completeness milestone, at the corresponding multiplier. Filing the initial form alone does not necessarily start that clock.

Appendix example: management fees paid in REIT units

The illustrative anonymised summary concerns whether service value can use agreed cash fees rather than the market price of units received. An independent manager provides strategy and asset acquisition/divestment/development advice to a registered REIT, paid in cash, units or both. Section17(3) applies open-market value to non-cash consideration;17(5) identifies an unrelated-party monetary equivalent. Because the manager is not connected to the trustee/REIT and the agreed fees are benchmarked to unrelated-market arrangements, the example accepts those cash-equivalent fees. It does not grant all managers a general right to ignore market value.

Trustee connection and published-summary limits

The appendix notes that a trustee can be connected to a settlor, persons connected to that settlor and companies connected to the settlement under the Third Schedule. The independence facts therefore matter. The summary binds only its original applicant and specified transaction, and the CGST need not apply it to another similar transaction. Its headings show the publication format: subject, facts, law, ruling, reasons and reference disclaimer.
