NEMS GST: Electricity, Financial Hedges and Embedded-Generator Price Neutralisation

The twenty-two-page guide covers Gencos, market operator, retailers and MSSL. NEMS began trading 1 January 2003: generators sell to the wholesale pool and buyers buy from it; retail supply is a further transaction. EMA regulates, EMC operates the market, and the guide identifies SP Services as MSSL. Its phased contestability description is background, not a separate current eligibility test for every consumer.

January 2026 fourth edition and the market structure

The twenty-two-page guide covers Gencos, market operator, retailers and MSSL. NEMS began trading 1 January 2003: generators sell to the wholesale pool and buyers buy from it; retail supply is a further transaction. EMA regulates, EMC operates the market, and the guide identifies SP Services as MSSL. Its phased contestability description is background, not a separate current eligibility test for every consumer.

Nodal price versus USEP

Generators receive location-specific nodal/market-energy prices determined half-hourly. Wholesale buyers pay Uniform Singapore Energy Price, the weighted average of nodal prices for that half-hour. Generators/retailers meet licensing/registration rules; MSSL also meters/manages data and can sell to contestable/non-contestable users. Contestable users in the described structure choose MSSL/retailer/direct-market purchase; non-contestable use regulated MSSL tariffs.

Electricity is taxable goods and timing remains gross

GST-registered suppliers invoice at the prevailing rate on Singapore electricity. Approved self-billing lets the customer issue buyer-created tax invoices and send copies. Time of supply is earlier invoice (including self-billing) or payment. Financial hedge settlement does not reduce the underlying gross taxable electricity sale/purchase.

CfDs and vesting contracts are financial, not delivery

CfD links Genco and retailer at agreed quantity/hedge price. Above hedge price the generator pays retailer; below it retailer pays generator. Vesting contracts link Genco and MSSL under regulatory price stability, with gains/losses passed onward. Neither delivers underlying electricity physically between counterparties. CfD market-operator settlement uses hedge quantity×USEP; vesting settlement uses quantity×reference/hedge difference. Separate external CfD hedge-price payment is likewise not a goods supply.

Exempt hedge results and no-supply settlements differ

Compute CfD realised difference as quantity×(contract reference−hedge price), vesting with its own reference. Aggregate realised gains/losses across multiple contracts, then report absolute net amount as exempt supplies. Only counterparties report; market operator acting as settlement agent does not report those flows as its exempt supply. No-supply settlement is distinct from the counterparties’ exempt result.

All three onward vesting routes

MSSL→retailer passing gains/losses is no supply and not declared. MSSL/retailer→consumers is part of electricity consideration and standard-rated, including both consumer classes. Retailer→Genco as part of CfD is exempt and included in net hedge results. Whether retailer passes to consumers depends on its sales agreement; do not tax all onward transfers identically.

Embedded generation and mandatory neutralisation

Qualifying grid-connected embedded generators must sell generated electricity to operator at nodal price and buy consumption back at USEP. Invoice both gross flows with GST. For overlapping self-consumption, neutralisation removes price gain/loss: credit if injection price is lower, invoice difference if higher. A1000 injection/1200 consumption example leaves 200 purchased at USEP. Retailer purchases do not eliminate operator neutralisation.

Neutralisation is no supply, not exempt electricity

Statutorily mandated adjustment is independent of the retail price and is no supply. Neither party charges or shows GST on its neutralisation invoice/credit/payment voucher, and neither reports it in GST returns. Actual gross electricity supplies remain taxable. Do not net the adjustment off the taxable supply merely because cash settlement is net.

Direct input tax: taxable, no supply and exempt

Taxable-supply input is claimable subject to valid invoices and blocked-input regulations 26/27. Input for the specified no-supply vesting/neutralisation flows is claimable where business wholly makes taxable supplies. Exempt-supply input normally cannot be claimed, subject to de-minimis or listed-financial-supply rules. De-minimis requires both average exempt value≤S$40,000/month and≤five percent of total taxable/exempt value for the period.

Regulations 33–35 and both residual formulas

Utility hedges from taxable activity, including CfD/vesting, are regulation 33 exempt supplies. If only these exempt supplies and no regulation 34 business, recovery is permitted. Mixed non 33 exempt supplies failing de-minimis require regulation 35: non 33≤five percent of total allows 33-related input, otherwise exempt-attributable input is blocked. Residual recovery when no 34 business and 35 passes is residual×(taxable+33 exempt)/total; otherwise residual×taxable/total. Total includes both exempt classes, with permitted 29(3) incidental exclusions.

Appendix 1: physical electricity and CfD scenariosA/B

Genco injects 1000 at S$96, sells S$96,000; operator buys that and sells retailer 1000 at S$98, S$98,000. Each invoice/input/output uses prevailing GST. Hedge 800, reference 98: at hedge 100, Genco gains S$1600 and retailer loses 1600; at hedge 94, Genco loses 3200 and retailer gains 3200. Operator settlement at 800×98=S$78,400 is no supply, without reducing physical GST. Both sides report absolute relevant net exempt results.

Appendix 1: vestingC/D and passingE/F/G

Quantity 800 and vesting reference 97: hedge 100 yields Genco gain 2400/MSSL loss 2400; hedge 94 gives Genco loss 2400/MSSL gain 2400. Operator settlement is no supply. E/F passing either MSSL loss or gain to retailer is no supply; G retailer passing to generator in CfD is exempt. The table uses the same reference-minus-hedge expression in both columns but assigns opposite gain/loss signs by party; the generator result is the reverse of that scalar arithmetic, so do not copy its printed equality as a standalone numerical equation.

Appendix 2: purchase direct from operator

EG1000×96 sells S$96,000 with output; operator 1000×98 sells back S$98,000 with output and EG input. Neutralisation 1000×(98−96)=S$2,000 credit has no GST. Operator correspondingly has S$96,000 taxable purchase/input and S$98,000 sale/output. Input entitlement remains subject to recovery conditions rather than automatic merely because figures are shown.

Appendix 2: purchase through a retailer

EG’s S$96,000 sale to operator remains. Operator sells retailer S$98,000; retailer sells EG1000×100=S$100,000. All three actual sales/purchases have their respective GST. Operator→EG S$2,000 neutralisation remains no supply, despite the retailer’s higher S$100 unit sale price. Thus adjustment is based on USEP versus nodal price, not a refund of the retail markup.

Versions, units and supporting guidance

The guide retains MW and$/MW in its illustrations; these are its stated illustrative units, not a conversion exercise. The 2023 amendment replaced oldseven-percent calculations with prevailing rate and updated self-billing reference;2016 clarified incidental supplies in residual denominator. January 2026 is the printed fourth-edition date. Use official partial-exemption/input-recovery and invoicing guidance alongside this source; contact GST Division through IRAS Contact Us.
