Why Singapore participates
The three-page FAQ links spontaneous exchange of certain tax rulings to a BEPS minimum standard for members of the Inclusive Framework. The subject is specified rulings, not indiscriminate exchange of all taxpayer material. It refers to five ruling categories elsewhere but does not enumerate them in this short PDF.
All three recipient-jurisdiction conditions
A jurisdiction must have a Singapore treaty or exchange arrangement authorising spontaneous exchange, legal protections for confidentiality and appropriate use, and a matching commitment to compulsory spontaneous exchange. All three conditions matter. Ordinarily recipients are residence jurisdictions of related parties involved in ruled transactions or related-party income benefiting from preferential treatment, including PE situations; and ultimate/immediate parent residence jurisdictions, plus the head-office residence jurisdiction for PE rulings.
The 25% related-party test
Relatedness arises where one holds at least 25% of the other, or a third holds at least 25% in both. Count direct or indirect voting rights or equity-interest value. The same threshold applies to entities such as partnerships and trusts. It is not restricted to direct ordinary-share ownership.
Confidentiality assessment
The Global Forum’s peer review of legal/regulatory frameworks and practical implementation strongly influences IRAS’s assessment of recipient safeguards. The source’s statement of over 140 Global Forum members is a version-specific description, not a fresh membership count today.
Two exchange deadlines
For rulings issued on or after 1 April 2017 but before 1 January 2025, exchange is as soon as possible and no later than three months after it becomes available to IRAS. For rulings issued from 1 January 2025, exchange is within six months of issue; issue means taxpayer acceptance. The older and newer clocks start from different events.
Will the taxpayer be told?
As a matter of practice, taxpayers are not informed whether or when information is exchanged, or who receives it. Expect covered ruling information to be exchanged within the applicable period and with qualifying jurisdictions. Lack of a notification is not evidence that exchange did not occur.
