A dated introduction to automatic exchange

This image-based two-page brochure is dated May 2017. CRS is the internationally agreed standard for automatic exchange of financial-account information for tax purposes, intended to improve transparency and deter offshore-account tax evasion. Its statements about more than 100 jurisdictions starting in 2017 or 2018 and Singapore starting exchange in 2018 describe the launch period, not a future timetable today.

What Singapore financial institutions do

From 1 January 2017, the brochure says Singapore-based depository institutions such as banks, specified insurers, investment entities and custodial institutions establish all account holders’ tax residences and report relevant account information to IRAS. IRAS exchanges it with jurisdictions covered by a Competent Authority Agreement (CAA), implemented through existing instruments such as the Convention on Mutual Administrative Assistance in Tax Matters. Overseas institutions similarly identify Singapore tax residents and report through their local authorities.

Existing, new and entity accounts

For accounts opened before 1 January 2017, the institution may ask for documentation even from Singapore citizens or permanent residents, or where existing information indicates foreign tax residence. For new accounts opened from that date, declare all jurisdictions of tax residence through self-certification. For company, partnership or trust accounts, information on the entity’s residence and sometimes the individuals controlling it may be required. Citizenship is not a substitute for the tax-residence inquiry.

Accuracy and changes in circumstances

Cooperate with the institution and provide accurate information. Notify it of relevant changes such as a long-term overseas job posting. Wilfully false tax-residence information is an offence; the brochure’s footnote states a fine up to S$10,000, imprisonment up to two years, or both on conviction. These are the brochure’s legal statements, rather than a prediction of a particular enforcement outcome.

Determining residence and finding help

For individuals, the brochure describes duration of stay as a general determinant; for companies, incorporation or effective management. It stresses that jurisdictions differ. Consult the relevant jurisdiction’s rules using the OECD tax-residency resource, ask that jurisdiction’s tax authority, or consult a tax adviser. The original lists the historical IRAS CRS website and CRS@iras.gov.sg, and explains that it is an introductory guide, not comprehensive advice on every tax issue.
