Purpose and limitations
This four-page checklist guides tax agents requesting GST technical clarification for clients. Its document lists are non-exhaustive and are not themselves approvals, rulings or waivers. Read the relevant underlying guide and provide the published technical-request information as well as the case-specific evidence below. No publication date is visible in this document.
1. Extension of the export sixty-day rule
For an export scenario needing separate Comptroller approval beyond the Exports guide, identify the applicable scenario, provide the commercial and transport records for a sample transaction, and explain with evidence why sixty days cannot be met. State the requested number of additional months and its basis, such as average or maximum export time; say whether it is one-off or recurring and include other useful documents. A requested extension is not an automatic entitlement.
2. Land GST for residential development
For Regulation 41 input claims or section 89(1) remission, state transfer-completion date. Analyse expenses concerning an existing building, which do not qualify as land input under this provision. If the building is leased after transfer, provide rent, term and lease facts. Supply Written Permission and independent valuation. If unavailable, explain and provide URA Provisional Permission and preliminary independent valuation splitting commercial/residential mixed-development components, or explain why these too cannot be supplied.
3. Alternative timing for the land-betterment formula
If seeking LBC rate and floor area for the period the invoice is posted rather than the period input tax is incurred, explain the inability to use the normal incurrence-period inputs, including commercial reasons. The invoice date is an example of the incurrence evidence. This category requests permission for a changed computational timing; it does not itself authorise it.
4. Transfer of business as a going concern
Analyse every paragraph 4 condition in the TOGC guide; explain how a transferred part operates independently; identify each party’s GST status; provide asset/business agreement and any applicable joint records undertaking; describe assets, full/partial transfer, money or non-money consideration, progressive dates, reasons and the transferor’s post-transfer business.
If the transferee’s agent asks for the ruling, obtain the transferor’s consent and give email/letter proof. IRAS will not issue it to the transferee without that consent. The joint undertaking referenced here concerns permission for the transferor to retain GST records instead of the transferee; it is not a replacement for all TOGC conditions.
5. Zero-rating and a different apportionment proxy
Provide the service agreement and evidence of actual nature, scope, activities, time and location, tied to contract clauses. Explicitly explain departures between actual work and contractual wording. Demonstrate the relevant section 21(3) conditions—for example direct-benefit and Singapore-goods connections in a paragraph (j) request.
For mixed Singapore/overseas goods, land or beneficiaries, explain why a published proxy in the directly-in-connection/direct-benefit guide is unsuitable and why the proposed alternative is more appropriate and equitable. An overseas invoice address by itself is not the requested analysis.
6. Blanket approval based on an earlier arrangement
A prior approval for the same taxpayer’s existing arrangement was based on its particular facts and must not simply be quoted as precedent for every new similar arrangement. Provide the information required by the technical-clarification webpage afresh, including where requesting pricing-display or alternative supply-time treatment. The checklist’s address and contact details are publication-document information; the current request channel should be checked on IRAS before submitting.
