The 2016 instrument
The nine-page agreement was concluded on 24 October 2016, with force and effect dated 31 January 2017. It is based on Article 6 of the Convention on Mutual Administrative Assistance in Tax Matters, not the Finland agreement’s DTA basis. The South African signature was made in Brooklyn on 11 October 2016 and the Singapore signature on 24 October.
Section 1: authorities and the residence test
Singapore’s authority is the Minister for Finance or representative; South Africa’s is the SARS Commissioner or representative. Resident institutions exclude foreign branches, while local branches of foreign institutions are included. Reportable status follows CRS due diligence and includes passive entities with reportable controlling persons, tax-resident individuals/entities and relevant deceased estates. Singapore uses its tax reference number and South Africa its taxpayer identifier. Unspecified tax-law meanings prevail over other domestic-law meanings when compatible with CRS.
Section 2: identity and account fields
Report name, address, TINs and individual date of birth; this text does not separately list place of birth. Report entity information and reportable controlling-person information where applicable. Account numbers or equivalents, reporting-institution details, balances/value, insurance or annuity cash/surrender values and account closure are exchanged.
All three income categories
Custodial accounts include gross interest, dividends, other asset income and sale/redemption proceeds where the institution acts as custodian, broker, nominee or agent. Depository accounts include gross interest. Other accounts include gross amounts paid/credited where the institution is obligor/debtor and aggregate redemptions. These are gross reporting categories, not net taxable-income calculations.
Section 3 and the Singapore-only first-year exception
Information starts with 2017, with exchange commencing according to Annex A and within nine months of year-end, where both jurisdictions have required legislation. Singapore does not exchange custodial gross sale/redemption proceeds for 2017; it adds those from 2018. Identify currencies, use CRS XML and agree encrypted transmission; payment characterisation can follow sending-country tax law.
Annex A: every account category
New accounts opened on or after 1 January 2017 have an intended exchange date by September 2018. Pre-existing accounts are those maintained as at 31 December 2016. High-value individual accounts are intended for September 2018; lower-value individual and entity accounts for September 2018 OR September 2019, depending on when identified as reportable. The annex is an initial timetable, not a current ongoing filing calendar.
Sections 4 and 5: compliance and confidentiality
Notify suspected errors or reporting/due-diligence non-compliance; the counterpart applies appropriate domestic measures. Convention confidentiality and permitted-use safeguards apply, together with personal-data requirements specified by the supplying authority. Immediately notify breaches, safeguard failures, sanctions and remedial actions.
Section 6: consultation and amendment
Either authority can request consultation over implementation or interpretation. Amend by written agreement; unless otherwise agreed, effective date is the first month-day following one month from the later signature or relevant notification.
Section 7: commencement, suspension and termination
Effect begins on the later notification that necessary implementing laws exist. This version does not reproduce the five-item notification checklist found in certain other agreements. Significant non-compliance allows immediate written suspension, including safeguard failure, inadequate/late data or exemptions frustrating CRS. Termination takes effect on the first month-day after twelve months from notice; received data remains protected under the Convention. The two English originals bear Chia-Tern Huey Min and Thomas S. Moyane’s signatures.
