IRS Notice 2017-46: Historical FATCA TIN and Birth-Date Transition Rules

This twenty-page IRS notice addresses two different subjects: missing US taxpayer identification numbers for Model 1 foreign financial institutions, and foreign-TIN/birth-date documentation by US-office financial-institution withholding agents. Its relief periods refer to 2017–2019. It is not a fresh 2026 exemption from Singapore FATCA reporting, and US TIN must not be confused with a foreign tax-residence TIN.

A historical US notice linked by IRAS

This twenty-page IRS notice addresses two different subjects: missing US taxpayer identification numbers for Model 1 foreign financial institutions, and foreign-TIN/birth-date documentation by US-office financial-institution withholding agents. Its relief periods refer to 2017–2019. It is not a fresh 2026 exemption from Singapore FATCA reporting, and US TIN must not be confused with a foreign tax-residence TIN.

FATCA background and the Model 1 reporting route

The 2010 HIRE Act introduced Code sections 1471–1474 for foreign-account non-compliance. Under Model 1, the FI reports US reportable accounts to its partner tax authority, which exchanges with the US competent authority. Model 2 is a different model. The notice traces 2013 final, 2014 temporary/coordination and January 2017 final/supplementary regulations to explain the transition.

US TIN obligation and the eighteen-month escalation

Required US TINs cover specified US holders and specified US controlling persons of non-US entities. Before 2017, missing-record TINs for applicable pre-existing accounts could be omitted; partner jurisdictions committed to obtaining/reporting from 2017. Significant non-compliance can be notified to the partner authority; unresolved non-compliance after eighteen months can lead to treatment as nonparticipating FI and withholding. Model 1 relief depends on proper registration, reporting and exchange.

All three conditions for the 2017–2019 US-TIN relief

For applicable pre-existing US-reportable accounts only, missing US TIN alone would not establish significant non-compliance for calendar 2017/2018/2019 if the FI obtained/reported the birthday of each relevant holder/controller; requested missing TINs from holders annually; and searched its electronically searchable data before reporting calendar 2017 to its local authority. This does not waive other reporting defects or chapter 3/61 payment obligations.

Who the foreign-TIN rules concern

Section IV concerns US branches/offices of depository, custodial, investment or specified-insurance institutions, and financial accounts as defined under 1.1471-5. Withholding certificates are W-8 BEN, W-8 BEN-E, W-8 ECI, W-8 EXP and W-8 IMY for a qualified derivatives dealer claiming dividend treaty benefits. The notice narrows certificate invalidity to US-source income reportable on Form 1042-S, rather than every payment or certificates obtained solely to avoid Form 1099/backup withholding.

Exceptions: exchange-agreement and no-TIN jurisdictions

No foreign TIN/reasonable explanation is required for residents of jurisdictions without the specified reciprocal US tax-information-exchange agreement. Use the cited Revenue Procedure list and later updates; if a jurisdiction is added, collect before Form 1042-S filing, including extensions, for the following calendar year. The IRS no-TIN list is another exception; the notice’s historical initial list is Bermuda, British Virgin Islands and Cayman Islands, subject to later updates when issuance changes.

Exceptions: institutional and territory holders

An otherwise valid certificate can establish government, international-organisation, foreign-central-bank or US-territory-resident status and remove the foreign-TIN requirement. Exceptions concern that field’s documentation, not an unconditional exemption from every tax/reporting rule. The notice explains why narrowing does not automatically impose backup withholding on individual gross proceeds solely for these missing fields.

Certificates signed from 1 January 2018 and knowledge standards

Non-excepted relevant certificates signed from that date need foreign TIN or a reasonable explanation for non-issuance. An explanation of no legal obligation to obtain a TIN follows the revised 2017 form instructions; other explanations need reasonableness assessment. The agent may rely unless it knows or has reason to know the TIN is wrong, and need not validate every jurisdiction’s format. A new residence address outside the certificate’s jurisdiction can create reason to know. It may rely on an explanation unless it actually knows a TIN exists.

Existing December 2017 account data limitation

For an account maintained on 31 December 2017 with a then-valid certificate, the agent’s reason to know a TIN is incorrect, or actual knowledge of a TIN despite an explanation, is limited to electronically searchable information in its files. This is the specified transition’s knowledge rule, not an instruction to discard evidence for all later accounts.

Before-2018 payments and three-year-valid certificates

Otherwise valid certificates were not invalid solely for missing foreign TIN/explanation on payments before 1 January 2018. For certificates signed before that date with three-year validity, relief for later payments ends at the earliest of 31 December 2019, certificate expiry or a relevant circumstances change. The end date does not extend the original validity period.

Indefinite certificates and the alternative procedure

For an indefinitely valid pre-2018 certificate, the corresponding relief ends at the earlier of 31 December 2019 or a relevant change. An otherwise valid old certificate can remain usable afterward if the agent obtains a written/email foreign TIN or explanation and associates it with the certificate, or associates an existing file TIN. Original expiry or other invalidating change still requires a fresh certificate containing TIN/explanation. The same knowledge standards apply.

Date-of-birth relief is a different timeline

A missing birthday on an otherwise valid certificate is acceptable if held in the agent’s files; a holder’s written/email statement can supply it. Pre-2018 certificates received a missing-birthday grace period only for payments before 1 January 2019. That deadline differs from the foreign-TIN 2019 year-end phase-in.

Form 1042-S foreign TIN reporting from 2018

For relevant US-office financial accounts, report foreign TIN on each required Form 1042-S from calendar 2018 if furnished on the certificate, obtained through the alternative procedure, or identified in electronically searchable data. Obtaining a field and reporting an available field are distinct duties; the notice anticipates revised instructions rather than saying all absence exceptions suppress data already available.

Form 1042-S birth dates, penalties and reliance

For calendar 2017 certificates furnished from 1 January 2017, report birthday if on the certificate or electronically searchable; from calendar 2018 include birthdays on certificates or identified anywhere in files. Failure to report required TIN/birth information can carry penalties. Before the announced regulations were issued, taxpayers could rely on section IV’s announced amendments. The named drafter/contact is historical; assess any present case using later official instruments rather than treating the notice’s expired transitions as current relief.
