Two commencement dates
The actual document is Gazette S 553/2026, the United States of America Amendment Regulations 2026, published and made on 11 August 2026. It amends the 2020 principal Regulations. Its regulation 3 took effect on 11 August 2026; all other provisions take effect on 1 January 2027. As at October 2026, the latter changes are prospective, even though the Gazette has already been published.
Own-account dealing: the August change
Amendment regulation 3 inserts principal regulation 7(4A). The exclusion concerns a person exempt from holding a capital-markets-services licence under Securities and Futures Act section 99(1)(h), read with licensing regulations Second Schedule paragraph 2(1)(a) or (e), who deals in capital-markets products for its own account. It is not a blanket exemption for every financial business. The amendment also deletes principal regulation 7(5)(a); this short Gazette does not reproduce the deleted text, so its previous contents should not be invented.
Trustee-Documented Trust and allocation of duties
From January 2027, amendment regulation 2 adds Trustee-Documented Trust to the principal regulation 3(3) table, referring to regulation 3(2) with Agreement Annex II Section IV paragraph A. Amendment regulation 4 requires the trustee of a reporting Singaporean financial-institution trust to comply with principal regulation 9(1) or (3). Regulation 5 allocates principal regulation 10(1), (3) or (7), read with (4) and (5), to trustees of reporting Singaporean financial institutions or investment entities that are trusts. Regulation 7 similarly allocates principal regulation 11(1) to the trustee of a reporting institution trust.
New nil-return requirement
New principal regulation 10A applies where a non-reporting Singaporean financial institution that is a Trustee-Documented Trust maintains no U.S. reportable account during a calendar year. Its trustee must prepare and provide a return stating that fact to the Comptroller or a person authorised under section 105L. Non-reporting classification therefore does not itself eliminate this nil-return duty.
Deadline, format and offence
The nil return is due by 31 May of the following year, or a further time allowed by the Comptroller, in the format described on the IRAS website. This is a requirement under section 105M(1)(b); failure or neglect without reasonable excuse is an offence under section 105M(1). The Gazette does not specify a fine quantum here or reproduce the full reporting schema. Keep the January 2027 commencement distinct from the August 2026 own-account amendment.
